    Moving out of state
    I want to move out of state with my 1 year old father doesnot pay cs no job no stable home long rap sheet I told him I was moving he thinks I'm joking should I wait and see what he does if he does not file a objection should I continue with the move either of us have the money for a lawyer

    First its not a good idea to piggyback your question on another thread. This can lead to confusion. So I've moved your question to its own thread.

    You left out the most key information here. Are there any court orders on custody and visitation? If there are, you need to go to court for permission to move by asking for a modification of the court orders. If you do anything that will interfere with court ordered visitation, then you could be cited for contempt of court and forced to send the child back.

    If there are no court orders, then you can move without going to court, but if he files you may be forced to return.

    Whether there are court orders or not, does he spend time with his child?

    There are no court papers , he comes over maybe twice a week for about 15 min

    So he can show that he does visit. Its up to you to take the chance that he will go to court. If it's a possibility then you should go to court for full legal and physical custody with permission to move.

    Thank you very much I'm thinking even if he did wich I really don't think he will go to court doesn't he have to pay for a lawyer even if its just visitation he trying to get

    No, there are fees that would have to be paid, but a lawyer is not necessary.
