    Civil litigation statute of limitations
    I am the executrix of my fathers estate. We made a offer to settle and the settlement was accepted by the other side. We have made many tries via letter and fax to the opposing lawyer as to where to send funds, and have not received any reply. Our letters and calls have gone ignored. This is since 2006. At what point can this offer be nulified and if possible have the funds returned to me that are sitting as a retainer at my lawyers office. The person suing is no longer living in the area and has a peacebond for fraud against her.

    If you want to know what the statute of limitations is, we would have to first know two things
    1. What state (assuming you are in the US) are you in?
    2. What was the claim for? Breach of contract? Tort?


    Also, in most states, if someone has a claim against an estate, he or she has to file a notice of claim with the personal representative or the court within a certain period. Was this done?
