    Yes, it's Family Court or something similar.

    If you are one parent and the other parent is deceased why are you paying child support and why don't you have custody?

    What am I missing?

    Got it - the Court can order DNA on a close relative of a deceased person. I don't know the exact relationship but I know a brother's DNA can be used if the other brother is dead.

    But you would need a Court order.

    You file for visitation, it would appear if you are already paying court ordered child support, you have already been declared the father legally. But you file, you can ask for the DNA test if you doubt the child is yours, if not you can ask for visitation, and if the mother asks for the DNA test they will order it.
