Can a Cosigners wages be garnished in Georgia
I live in Georgia and I had a friend to cosign for me for my car I have missed a coulple of full payments due to hour cut back but I still make the payments. She tells me that the people are talking about garnishing her check and came and took my car said she needed to use it , then called and said she wasn't bringing it back until I catch the 2 months up. My questions are how long does it take after you miss 2 car payments do the call and talk about garnishing you?
And can she just take my car like that if she is only a cosigner?

Is her name on the car title? If not she cannot refuse to return the car. But you let her use it so she didn't take it.

For them to garnish her wages, they would have to go to court for a judgment first. But yes they can garnish them. As a co-signer she is responsible for payments. If a payment is late 1 day they can contact her for payment.

Depending on what type of loan company, is this a buy/here pay/here type place or was it a loan though a bank, or a finance company ?

If it is a buy/here pay/here place they normally start calling about one hour after the first payment is late and would be calling anyone on your contact list you gave them by time the second payment is late.

Next almost any lender will be calling by the 2nd late payment and often will be repo the car by the 3rd late.

They will repo the car, at that point, you normally will owe more for a car you don't have than you did before they took it, they sue you and the co signer. They will then garnish both of your checks

You need to find a way to pay it, or sell the vechile, you friend was there to help you out, and now you are treating them like dirt not paying, making them liable to pay ( and destroying their credit where they can't get loans soon)
