My exhusband and I were reuniting and I have been ill for some years. There was misappropriate of my social security funds. Abuse from my family. I dropped my daughter off at my mothers to go to a nearby state to look for housing, again to reunite our family. I decided it was best to leave the state because of the misappropriation and the negative impact on my daughter of my family. When we came back to pick up my daughter, my sister had obtained temporary custody. Mother had regained payee position, after I had recently obtained it for my daughter. My exhusband and I cannot afford attorneys and cannot get help. Sister broke into my home and stole my journal from when I was at my sickest and attempted to present it in court. She stole it and shared the contents with my entire family. They are using that journal to say I am unbalanced, although I much better than two years ago. I watched the video and sister lied about everything, said I am violent, said I have a gun, said people are afraid of me, said daughter did not live with me, said she was never a felon, said father not active in her life, etc. I want to file a dismissal but we are 7 months in and they dragged it out until daughter just turned 16. The dismissal would be based on fraud, nonjurisdiction because there was an order in family court for custody already from the divorce so her father should at least get her, and based on stolen evidence. Would the dismissal be the best option?

I already filed breaking and entering and possession of stolen evidence and got a police report. By the way, we had one guardian and got a her put off and have a new one. The other problem is our daughter is lying to stay in the city with her grandparents and not relocate with us but they are listening to her! We, however, have her tweets saying that she lied, told the truth, and asking God's forgiveness for her indirect sinning...

At 16 your daughters preferences are going to be given a lot of weight. If she says she wants to stay with the grandparents the family courts are likely to overlook the other stuff.
