Is this malpractice, can I demand my money back?
I went to a dentist to have a tooth pulled. A few days later I had worse pain than before so I went back. He spent 5 seconds in the room, stuck a finger in my mouth looked and said it takes time to heal. It is now 3 weeks and still in pain, I paid to go to a doctor and he looked and said it is either bone exposed or a part of a tooth left. I paid another dentisty to look and he said exposed bone that should have been filed down at the time it was pulled so the skin can heal over it. If it is not fixed the pain will continue and eventually the bone will come out but it may be more than what is exposed. Now I have to go back, get more novicaine, etc and I don't want to go through this again, not to mention I already paid for it, and a doctor bill and another dentist bill.

Every person heals at a different rate based on many factors. Bone chips can work out of a socket even after the area has started healing. If you had a good dentist who did the initial surgery, all the followups should be covered under a "global" period for surgery. It is not a malpractice issue from the information I saw. Maybe there was a lack of communication as to what needed to be done post surgery, etc.

So I went back to the dentist at sexton's dental clinic, he said he doesn't see any bone sticking out. He said the only time he does something with bone is if it is splintered. He said he can send me to an oral surgeon but then said it could take up to a year to heal. So I will wither away cause I am having a terrible time trying to eat anything without pain, milkshakes work to get something down. I just don't know what to do now, wait it out and see what happens or pay another dentist to see what he thinks and go by what the 3rd one says. I guess it can go either way.
