    Probate and Trust Attorneys in Massachusetts. How do you become an executor of a
    Deceased brothers estate when two to five years of social security benefits could be approved if justified. My brother was entitled to his social security benefits due to being deathly ill and unable to work for the past five years of his life. The final judge could not believe that his benefits were not granted and sent it back for approval yet my brother died before his answer. The Judge is willing to award if an estate can be justified to entitled beneficaries. Who do you recommend I speak to?

    An executor needs to be appointed to manage your brother's estate. Did he have a will? If not, then the probate court will appoint an executor. If he had no spouse then a sibling or child could be named executor by the court.
