    Selling a house with two names on the title
    My ex and I bought a house together 3 years ago. We broke up last January and I have been trying to figure out for a year what he wanted to do with the house. All he kept saying was his lawyer was taking care of it. After a year of dealing with his lies and run-arounds, I decided to look into what my options were. I was told I could force him to sell the house. While looking into this, I have found out that he has had the house up for sale for over a month now. He tells me that he can sell the house without me knowing and I wouldn't get anything from the house once it is sold. I just want to know if he is right or not?

    If your name is on the deed then he cannot legally sell the house without your signature. However I suggest that you keep a close eye on the progress of the house and, once he finds a buyer, do not even think of signing anything unless a title company, mortgage lender or attorney is handing you a check at the same time.

    You need to go down to the court house and see the way the deed is done.

    Also remember he is most likely lying or will try and forge your signing. Have you notified the broker who has it for sale that you are also co owner of the home.

    You say you "broke up" last January - does that mean you either have gotten a divorce or are in the midst of finalizing one? If so, your divorce agreement should be quite clear as to how proceeds from the house sale is to be treated. In general, whomever put in the down payment when you bought the house should expect to get that back, and any appreciation in the value of the house during the time you were marrried should be split. But of course it's all negotiable. So what does your divorce agreement say about the house?
