    Can she just take off with my brothers child to a different state?
    Hello.. on behalf my bro!
    My bro an his girlfriend moved way to another state to have there baby in aus to be with her family ( right thing to do) he has now left her and she was letting him have bubs over night thou day and making it all easy... but now its gone down hil she want to move state and is not letting him have anything to do with his child? They are about to go thou medation but is it tru she can just pack up and leave and head to a different state and not let him see her if there is no orders in place? He wants to see her and pays childsupport and buys so much for her when she is on a single income earning more than him because he is on a trainee ship it seems so unfair he knows no one over there and she has all her family standing in frnt him to not let him in!

    I'm going to give this a shot -

    If your brother has not gone to Court to be legally named the father of the child the girlfriend can take the child and go anywhere she wants to go. He has rights but he cannot enforce them.

    Mediation? Who is mediating this situation and why?

    If he wants to see his child he needs to go to Court and ask for an Order allowing him to see the child. At this moment she has all the rights.

    NOW - if they've already been to Court concerning paternity and/or support and/or visitation he would go back to Court (if she's not obeying the Court Order) and get it enforced.
