I got a DUI in the state of Illinois about 7 months ago. I was placed on reporting court supervision. The problem is, I am on the verge of becoming homeless and I have a really great opportunity lined up for me out in California where my Aunt is a disabled veteran and she is registering me as her caregiver. Also, my Fiancé is living out there and we are planning to get married as soon as possible. The only thing keeping me here is this probation deal. I want to know what I can do to be eligible to move out of this state as soon as possible. Or would it be best for me to try and motion my case back into court and bring it before the judge to see if she will accommodate this in any way?

You can ask for your probation to be transferred to California. This should not be a problem for you. Just speak to your PO, and he/she will get you in front of the judge where you can plead your case for a transfer.

Definitely. I really appreciate your time. I talked to my P.O yesterday and she said that a first offense DUI is not eligible to transfer out of state, but I could bring it before the judge and see if she can change the sentence so that I can. The way I am intending to go about it is finishing up my community service, classes, and getting all if not most of my fines paid off before bringing it to the judge to consider. I also am eligible for early termination of the probation so I'm hoping that if I accomplish this within the next few months I will be able to get it terminated completely.

It sounds like a good plan... The only problem is, it's based on hopes and dreams - NOT on reality.

Now, I don't know IF a 1st offense DUI would or wouldn't be eligible for an interstate transfer... I certainly don't know WHY it wouldn't. Are you saying that you have to be convicted of it AGAIN in order to be eligible for a transfer?? THAT makes no sense... So, I don't know if your PO is LYING to you or not... But, certainly, they DO lie, and I think yours is.

The way to find out, is to DO what my post says to do, otherwise you're just whistling dixie.

Yes your PO is blowing pure BS at you, now often they don't want to allow the transfer till classes and the community service is over But 1st DUI or 10th, they can all transfer,

Again, the PO has a written policy to do this and you have the right to see it.
