    Medicare/medicaid sale home.
    "My mother got ill and we had to place her in a nursing home. The state took over as her guardian, in order to get medicare/medicaid the state wants to sale her home. I am one of the names listed on the deed. (It was signed in 2003) Can the sale the home and if the do am I do I get payed for my portion?"

    Have you told the State that she does not own the home outright? How long has your name been on the deed, the Feds have rules about this for Medicad, not the State

    Usually in order to be a recipient of medicare/medicaid your mother can not have any assets or holdings. When you state that you are one of the names on the deed... How do you all hold title on the deed? Do you have Fee Simple title? Joint Tenancy with Right of Survivorship? Or Tenancy in Common? In certain situations you might have a percentage type ownership (e.g. Be given a percentage of the proceeds)in others maybe none. In certain situations the state cannot proceed with the sale without your signatures and in some situations they might be able to do so. Please let me know what the actual recorded deed states.
