I receved a notice to quit to be out by 1/26.
I received a notice to quit to be out by 1/26. I am actually moving on 1/28. Will they come take my stuff before then? What are the next steps? I live in a apartment community that is high priced... want to make sure they don't lock my door!

Did the notice come from the landlord or from a court? If the notice came from the landlord then they can't just lock your door. A notice to quit is the first step. If you haven't moved out by the quit date then they would have to file a lawsuit for eviction. If you still haven't moved out by the court date and they receive a judgment from the court then they would have the sheriff or constable come out to perform an eviction. I don't see them getting a court date and judgment within two days.

If the notice came from the court or a constable or sheriff then they can and will lock your door on the 26th.

I would go to the landlord or property manager. Show them proof that you will be moving on the 28th and ask for the 2 days grace.

But as Lisa said if the notice is not from a court, they will file for an eviction notice on 1/27, that should give you time to vacate.

But of course we are telling you legally what the landlord is suppose to do, in real life, there are 100s of illegal evections every week somewhere. So talk to the landlord
