    I own a home and I have a tenant who is a tenant at will I need the apartment for family do I have that right

    What do you mean by a tenant at will? Do you mean month to month, no lease?

    Yes, you can evict the person - in some States, however, you cannot evict during the Winter months and in other States you can only evict for certain reasons, moving into the apartment yourself being one of them.
