Hi, my name is mel and in 1999 I married a man who I thiought I would be with for life. I already had a 4 year old from a prev relationship. Later in 1999 I gave birth to our son, during the next 3 years I lived with domestic abuse, he hit our young son, he mentally hurt my elder son, to which he still has problems with. He stole from my son and sold his things, he was abusive to me all the time, he would threaten the kids during holiday time if he didn't get any sleep, he allowed our son to roam whilst I was in work and he slept. I plucked up the courage one day to say it was over, with that he emptied the bank account and left me and my children penniless. He caused us to be homelessa and had my car repossessed. He did never pay towards our son and went to form a bond with a new family. He has now returned and tracked me on Facebook demanding to see my son who kinds knows him but is in no way bithered about seeing him... I think he has done too much, I am receiving mental health help from all this as when he left, he came back at alater date and broke in our home and took my sons ps2, Game Boy and all the dvd players I owned, not to mention the mess he left behind breaking in. When I found out we were losing our home, I had my father clear the loft and up there was a cross from a grave.. belonging to his step father.. two years prev he lost his step father to cancer, two weeks after the funeral his distraught mother rang saying how his cross had been stolen and the grave ripped to pieces, unitl then I had no idea it was the man I was married to. I really don't want my son to see him,I don't think my son would want to, he did have litle access back in 2004 and it was reported that he was left to play alone in the road in bust streets in Manchester... I filed for divorce in 2004 and no solicitor, court bailiff or tracing agent has been successful in finding him, he gave numerous false addresses and I am still unable to get a divorce after 7 years. Lo and behold he has found me on Facebook because he wants something.. please help

So at the divorce was there a order for custody ?

Was he listed on the birth certificate,

Was there a order for child support.

IF, he is on the birth certificate and you never got a custody order, legally right now, he has every right you have to the child.

If there was a custody and/or visit agreement, his rights stand until you go back.

If you show evidence of the abuse, police reports, doctor records and the such, you should be able to limit him to no more than supervised visits.
