    Theft under/assault 1st offence my experience
    I am a 24 year old male from Toronto. Long story short I was charged with theft under and assaulting store security the item was under $10. I wasn't guilty of theft, but I did try to flee the scene. Anyway, I was accepted for a diversion program immediateLY and I agreed just to get on with my life since the charges will be withdrawn who cares. The reason for this post is calm down other FIRST OFFENDERS who are in a similar situation because I was extremely worried. This site was very useful however nobody in the other threads I've seen had an assault charge with their theft charge so I was unsure if I'd qualify for a diversion.

    This happened in Toronto? Did the Crown immediately offer a diversion? Was the Loss Prevention officer claiming injury as a result of the "assault"?
    I'm in a similar situation but worse and it seems like my outcome is much bleaker. Not offering diversion but rather 7 days Jail. Any suggestions?

    A lot will depend on the amount of assault and who the assault is on. If it is merely jerking free, or was someone actually hurt. It will make a difference.
    Also, how the injured party is talking to the crown.
