    DYFS case not in good faith as punishment for calling DYFS on him
    My sister in law and the father of her baby are fighting back and forth about custody of their child and where the child should reside. Basically they are in the preliminary stages of the court system. They were never married. I made a DYFS report on the father in good faith about the living conditions of his house, especially if he was going to get custody of the child. Now, he's threatening to have his friend also call DYFS to make a report since he knows it was either myself, or the mother's sister that called DYFS. Will DYFS notice that it could possibly be a false report since I did not do it anonymously and will DYFS inspect the situation? As far as I hear from the mother who talked to the father, they are going to complain that we do drugs in the house with our five year old is home. Both myself and I have been drug tested recently and can prove that we don't do drugs. And since he is making false claims trying to get back at us for making the report what legal actions can we take. What kind of proof do we need to prove that he had his friend/maybe himself call to make a malicious claim. He is also calling on the mother's sister since he thinks it is either myself or the sister who called. All this is happening during the court proceedings and we have nothing to do with the case. We will act on legal action against the father and were curious what would happen and the case we would have. Any info would be appreciated. Thank you.

    First, DYFS will probably be required to investigate any reports. So, if you are called by them, tell them they are welcome to investigate since you have done nothing wrong and have nothing to hide. Tell.them that you suspect the complaint was made by this person in retaliation for you're filing a report on them. Give the name of the caseworker you spoke with.

    Im not convinced this was some good faith effort on your part as your claiming it to be. From what your saying your trying to interfere in your sisters life. If they had custody before the courts it was up to your sister to mention if there was a problem. From the sounds of it you decided to up the ante on things. That is not good for the child. If he claims to suspect something and it turns out not to be true then that is all it was at the time.

    There will be nothing to sue over. Many innocent parents are dragged through the system every year without proof at all.
