    Theft under $5000
    I was wondering, one of my family members is being charged with 12 counts of fraud (he only took one thing though so I don't understand that part) and also breech of trust. He has already paid back the majority of the money taken. He has not yet gone to court because it keeps getting postponed. When he does go to court will he go to jail? That would devastate him and his small family. ( I realize what he did was wrong and of course so does he) This is his first offense, he is over 40 and we live in Canada. Could someone please ease my mind? Thanks/

    Hello S:

    There's a lot more that goes into sentencing than you have provided... But, even if we DID know everything that a judge is going to know, we couldn't tell you what's in the judges mind. The only thing I CAN tell you, is that in the ordinary course of events, he SHOULD get probation.

    What more info do you need? Sorry I don't really know much about this stuff. If he gets probation will he still be able to go back to work? He works in a different province. Please let me know any more info that you need I will gladly give it. Thanks so much for your help.

    Like I said, even if I knew it ALL, I still couldn't tell you what a judge would DO with that information... If he works in another province, he may need to transfer his probation there.
