How can you best prepare for court over an accident that happened over a year ago?
I was involved in an accident on 7-31-09. I was making a left turn on a green arrow light and the other driver ran the red light. My insurance company found me not at fault, but after all this time the other insurance company is taking it to court, picked up the letter that was filed in my county's courthouse by certified mail on 11-12-2010 and gave they me 20 days to reply, nothing was sent to my insurance company, so I had to fax this to them. I called a Lawyer and he said not to worry , that my ins. Company will get their best lawyer and settle it. My ins. Company called and said that they would counter sue. I would like to be prepared and know what to expect. Also how best to prove that I wasn't at fault. IF you don't prepare for something you're preparing to fail , as my brother has always said. Another thing if it goes to court and is it heard by a jury and they find me at fault after my ins said that I wasn't at fault , how does this affect your driving record, in other words will this be on my record after my ins. Said I wasn't at fault?

Hasn't the lawyer that represents your insurance company contacted you about this? If not, I would definitely call him/her as they will be far better equipped to guide you through this. They'll have all the specifics which are just guesses to us here; they'll have the police report, (hopefully)pictures, etc.

The insurance company will most likely have an attorney there. But there is nothing for you to do, you show up and merely tell your story, You may want to have a copy of the police report with you,

It will not effect your "driving record" is tickets given, civil law suits don't effect this.

Again the insurance company shoud be the one with all the evidence to provide

    Hello s:

You don't need to prepare anything.. Your insurance company will do all the preparing necessary.. It's THEIR money on the line here - not yours.
