    Rent room mate owes me.
    My room mate messed me over on my rent and bills etc... He signed an IOU stating the next day he would have me the money or he would get a title loan on his car to pay me the next day. He signed and I signed and its also dated... Im a college student and don't have time to waiste if I'm not going to win. Any advise?

    It would be easier to give you an accurate answer if you told us what was going on. Stating that he "messed you over on rent and bills" doesn't tell us what your situation is.

    What exactly does he owe you money for?

    My roommate is gone and not on lease
    My roommate just up and left on the 5th of October, the rent was already late. There was nothing I could do, he said he had the rent and on the 3rd when I pay it he didn't have it and said he gets paid on the 5th so he will pay his half and also the late fee + $30/day it was late. On the 5th he was at work and I called to see if he was going to have it and let him know that his half was going to be $570, and his half of the electric bill $200 (each) and $20 for water. He owes $790, he got very pissed off and said I was screwing him over because that's too much. He left work and called on his way to say he was going to get his **** out, I'm a 22 year old college student and was verry mad and told him nothing was leaving this apartment until I had my money or he signed a promissory note, he signed the note that stated he would either get me the money or the next day (6th) he would "get a title loan on his 98' green ford expedition" I wrote the promissory and he signed by the date and also I wrote both or names on it and we both signed next to our names. I was told this would be perfect in a small claims court, THEN I REMEMBERED HE IS NOT ON THE LEASE AT ALL!! So I decided to just count my losses and be the bigger person, about a week later I went to my hometown for a weekend and when I came back it was broken in to... when he lived there we were best friends for 2 years in college, so I trusted him. He told me one of the windows in the apartment would not lock... I just blew it off, come to find out he had it alllll planned out, I can not prove it was him that did it so I just got new stuff. He took my dads 357 mag and also a perfect condition 40 year old double barrel browning 20 gage... they were VERY sentimental, since my dad died when I was 6, he also took my Gretsch chet adkins guitar. All 3 were worth about $11,000... it KILLED me! And my moms heart was broken, but still I can't prove it so I wasn't going to put my college to the side for just things... Day before yesterday my truck wouldn't start because of the cold weather all night, I am in school to be a diesel mechanic. I got in my back seat to get some tools and my digital multimeter, it was gone also, so at that I had enough and I really want to sue him. Hes a 25 year old spoiled **** that lives with mother now. I know all the details I need to know about him etc... But he is not on my lease... Im at the point to where I would probably spend $5000 just to make him pay $3000. ANY ADVISE?

    I am not on the lease at the apartment with my buddy that I just ran out on after rent was due, I signed a promissory note saying I would give him $810 for late rent and half of all the bills. When the 5th came around I decided to just haul ***. Now he is saying he is going to sue me. Can he sue if I was not on he lease at all and the office did not know I was living there. He does have a lot of people that know I was living there. The promissory note also stated that if I didn't have the cash by the next day I would have to get a title loan on my 98 ford expedition. Will this hold up for him in small case court?

    What's the truth here? Did he screw you or did you screw him? On your other thread it seems he was not on the lease and he was the one left owing YOU money.

    Haha yeah man, I'm just getting advise from my side and from his side... I am the one that got ****ed over. I am on the lease and he is not, I do have a legal promissory note that he signed and dated etc... I hate this son of a ***** and just need to know what people think about it holding up in court since he's not on the lease

    Im really sorry, He is not on the lease at the apt, he didn't pay rent and was very late. I wasn't going to sue but then he broke in and stole my dads 357 mag and also a 30 yr old db 20g, I can't prove he did that but I know it was. So I want to sue

    Him for every little thing that I can prove he did in court. In small case court, it wouldn't matter if electricity got shut off on me for 8 days, and I had no where to go. (pain and suffering)

    First, please don't use the comments feature for followups. As you can see, the space is limited, use the Answer options instead.

    Second, I'm not sure whether a promissory note was the correct document to sign. Did you get a promissory note form from a stationary store or someplace?

    Third, if he was not on the lease, he was still your tenant. As long as you have proof he was paying you rent or that you had an agreement that should be sufficient.

    It sounds like you have enough to prove he owes you the money. So you would win in court, but then you have the problem of collecting. You would have to either garnish his salary or attach his bank accounts, if you know where they are.

    As to the burglary, you did report this to the police? You did have renter's insurance to at least recover the value of the items?
