    Chemicals and Breathalyzer
My son works in a printing company that uses LOTS of chemicals that are alcohol based. All the labels say to wear a mask and use gloves. Neither are provided to him to use. These chemicals are inhaled daily, soaked into his hands and even get spilled on his clothes. His eyes burn when leaving because of the chemical smell.

He works second shift and was going home at midnight the other night and was pulled over. It was a random stop as he was not doing anything wrong. The office said his eyes were red so they did a field sobriety test on him. He passed perfectly. Walked a straight line and did the ABC's front and back. Not a problem. Since he's a 19 year old kid, out a midnight the office didn't believe him that he wasn't drinking. He did a breathalyzer on him and said he blew a .05 which is under the limit. He cited him for operating a vehicle under the influence as a minor.

My son has never been in trouble before. He's a good kid with a good job. He swears he was not drinking. He was cleaning his presses that night. And his boss was there all night. He was pulled over 15 minutes after he left work. Can you tell me if alcohol based chemicals would cause a false positive on the breathalyzer. If so we are going to fight this so it doesn't show on his record.

    Thank you so much!

    Hello DC:

I cannot. But a good lawyer surly might. Besides, you're going to need one in order to win. You can do it by yourself.

A friend was arrested for DUI. Refused to take the breathalyzer test, and requested a blood test. The lab tech at the county jail was unable to collect blood after 2 tries, so my friend said, no more. Would that be considered refusing to submit to a test? Does that mean there is no evidence of...
