    Breathalyzer underage drinking
    Does any one know about the law that juveniles cannot be breathalyzed unless the police have parent consent. This is for the state of PA

    Sandygirl, I can't find a ruling for PA, although one for Michigan and Utah which says they can give breathalyzer test to minors without parental consent, and well it should be. Minors getting behind a wheel and driving while ontoxicated should be treated the same as any others. My concern is of course, no one, I don't care how old they are should be leaving a bar or party after drinking and then getting in a car and driving. Even one drink, depending on the person, is enough to be considered impaired.

    The legal answer is yes, the Police can breathalyze without parents being present. The law is rather vague about blood testing.

    Pennsylvania is also hard on people who have been drinking - but you probably already know that.

    A juvenile does not need to be legally drunk to be breaking the law. Just one drink makes them guilty of under aged drinking whether they are impaired or not. Maybe you can tell us the underlaying situation that brings this question up.
