    Breach of commercial lease in California.
    I bought a commercial building that had a tenant. The lease had a rent escalation provision. However, the tenant paid the previous amount until I noticed the discrepancy. Now the tenant pays the current amount, but has refused to pay the back rents to cover the escalation amounts and late fees. These fees are considerable and go back for back for several years. Other than this issue, the tenant is a good tenant. I would like to keep them. What are my options?

    Forget it, he is paying th amount now, you did not notice it yourself when it was happening ( for several years)

    Have you went and even talked to him and asked him what he though was fair to settle it

    Hello T:

    Any option you have is contained within your lease. If there's none, or even if there is, you might have to sue your tenant for the back rent, and let a court decipher your lease... Or you can let slide.

    There are NO commercial landlord/tenant laws like consumers have.
