    Firing a public defender?
    What happens if I fire my public defender in court? Do they give me another one or what happens?

    Hello cobra:

    The only possible reason to do it in court is to embarrass him. It's not going to HELP your case. I don't know if they'll give you another one. It depends on WHY you're firing him.

    If you really want to fire him, and have a chance at getting another one appointed, write him a letter telling him WHY. Send a copy to the judge and another one to the prosecutor. If you're not in jail, send your letters certified, return receipt requested.

    In your letter to the judge, ask him to appoint another lawyer.

    You may get another public defender after you fire that one. Most judges will appoint another public defender BUT they will caution you at the time they appoint the second one that the NEXT one is on your dime. So be careful in accepting the next one, as it is more than likely your last one.

    If the court believes this is merely a stalling issue, they may or may not allow.

    Also the why, since in many places, there are only a few PD and they are all buddies in the same office. But I am sure that would not effect their opinion to helpyou
