I am trying to sell my house but my brother is on my land without my concent. He just showed up one day and stayed. I told him he can stay for a week because our mother was ill. Now he refuses to leave and our mother has passed. The house is in my name and it has been for over 30 years. My father gave it to me when he died. The deed is in my name. My mothers last wish to us was sell the house and get out. She wrote notes to all of us saying this. Now I am trying to sell and he refuses to leave. He is not paying rent or the taxes. The house smells and is deterating and lossing me money for selling. There is no electric or water. He has two kids there. I have called the police to have him removied but they say they can't. There is a no tresspassing sign on the land. With the passing of my mother and trying to deal with the house I have entered myself into a mental rehab.. I had a nerves break down. My niece who I will be living with is trying to handled it for me but she is getting the run around. She called the local municipal building they sent her to municipal court, they sent her to surpreme court and they sent her to south jersey legal which they gave her another number... can anybody help!! The house is in south jersey

Hello:

You need to evict him according you're your state' landlord tenant law. You can probably do that at your local justice court. The procedures aren't difficult to understand. We have a copy of your law at the top of the real estate page on a sticky note. If you and your courts are efficient, you can have him out on the street in three weeks.
