How do I change jurisdiction from MO to MI
Ok.. Ive been reading a lot of the Q&A's about this & it seems that the original state the order was drawn up in will have jurisdiction.. unless the father doesn't live there or agrees to change the order's jurisdiction. My son & I live in MI & the order is in MO. We have been here for 8 yrs. My son recently was shot while in the care of his father for visitation. He had surgery & the pellet is still in his back. How do I change the orders jurisdiction? The father says he lives in the state however all his mail goes to the sister state IL. These are 2 ways I can change the jurisdiction correct? 1. Father doesn't live there & 2. an emergency situation? Should I file a Registration of Foreign Judgment in MI? I researched this & I do not see that MI is a state that adopted this? I have spoke with attorneys in both states & no one is helping me. Please advise. Thanks

If MO issued the original custody order and the dad still lives there MO has continuing exclusive jurisdiction. The only way that can change to MI is if the dad moves away from MO or the MO court decides to give up jurisdiction and allow it to transfer to MI. But you have to ask the MO court for that. A MI court cannot touch the case at the moment. Emergency jurisdiction won't help you. It's only temporary and will be time-limited if granted.

Oh, and incidentally the dad cannot agree to change jurisdiction in this case (that only applies to child support, not custody).

There's no need to register anything in MI, so forget that. It would serve no purpose if you could anyway.
