My sister passed away a year ago to day, she has two daughters one who is 19 and lives with me, the other is 16 and remains with her dad, she is living at a house that is not suitable to live in so she sleeps in a camper. She eats fastfood every other day, skips school like crazy, and doesn't come home until 11 or 12 at night. Her dad pushes her calls her names like whore, and slut. He and my sister were battling a divorce before she died and he used to abuse my sister, now that she is gone he takes his abuse out on my niece. Who we believe isn't even his real daughter. Before my sister died she said he wasn't. He blames me because of her actions and said if I wouldn't have let her sister live with me they'd be together and she wouldn't be acting this way, she just wants to be loved, and wants to be with my other sister who treats her like her own, what can we do.

Also he smokes marijuana and she takes his drugs, we are so worried about her, my sister died of a drug overdose and we are afraid she may try to do that, just to be with her mom, he is stupid and isn't even trying to help his kid, but he didn't try to help my sister either he just threw her out on the street. Please help us. We lost our sister we don't want to lose our niece.

What you could do is turn her in for taking drugs. That will start an invetigation and if they take her away from the dad then you can ask she be placed with you. Other then that as an Aunt / Uncle you have no specific rights to the child. In some states they allow for GrandParents rights but that isn't your situation.
