    Rights of the father after divorce settlement
    I have been divorced for a few months now, I have four children and pay a lot more the CSA calculated amount of maintenance. The ex wife and partner has moved(with children) to another country with work, all was amicable and agreed on the divorce that I can fly and see children or if they come back to UK when ever I financially can as long as I give notice. Its been a few months now and now she is making it very difficult to let me see them. What rights do I have to see my children, and if she doesn't comply do I have a right to bring my children back to the uk for more access. The ex wife is british, and all four children are british.

    Hi , I feel for you. I am going through a similar issue - My wife is from Malta and she is threatening to take our 3 year old to live in Malta. What country are we talking about - I am not a solicitor but would think that if it is an EU country you may have to go through the courts in that country? That said I have heard of something about the Genvia convention whereby there is agreement between EU countries to stop child abduction.. =- I know yours is not strictly abduction but ultimaltey if she is stopping you from seeing your children then it amounts to the same thing? Good Luck - keep hoping... things will change...
