    Child not living with ex-ex keeping child support
    Went to court to change child support as my child stated she would be moving out of her mother's home. At the time of the hearing, my child had not yet moved out. Her mother had threatened her too much. The court ruled that child support continue. The court also stated that medical arrearages could be attached once the ex provided the proper information or I could pay in one lump sum. A USO was also attached to the ruling so that took precedence over the written word and my pay is being garnished for arrearages that I do not owe and can prove I do not owe. The ex lied once again to the court. I filed a motion for reconsideration stating that my child has moved out of her mother's home. The mother is keeping all the child support and not giving any money to the child. The motion also stated that the ex did not provide the proper info and that the amount of arrearages is incorrect. The ex included an old GAL fee that the court said I do not have to pay. The ex included bills that I can prove that I already paid. And the ex double billed, so I do not owe nearly as much as she stated. Also in the motion I stated that the medical insurance that I am forced to buy does not work where my daughter lives. This motion was denied, so I am paying support that my child does not receive, I am paying for arrearages that I do not owe and am paying for expensive insurance that is basically useless. How can that be? What can I do about it? My child is now 18 and living with her boyfriend. She has one more year of high school. Child support will end once she graduates. The ex has broken the previous order that came out in 2001 over and over. She has lied about her income and perjured herseld in court. The court used her lies to determine the orders. Would a motion for contempt provide any relief or would it be a waste of time? The court (in NH) has continuously unfairly ruled against me. What can I do?

    If your ex is in contempt, then I would file against her for exactly that. As far as what has gone on before and why the only person who knows is the Judge.

    Do you have a lawyer? If not, I recommend that now would be a good time to get one.

    Hire a private investigator. Have them do the background research on where exactly your daughter lives. Then you will have an independent witness to your story. When under consideration in the courts they also have to consider motive. And when your asking for lowering of support what your really asking for is that hell freeze over. So unless you have solid evidence and not just he said she said your not going to get what you want. I agree with the others that you need a lawyer to walk you through all of this.
