    Voluntary termination of parental rights
    My husband and I have been fighting with his X and daughter for the last 4 years about what is in his daughter's best interest. His relationship with his daughter has continually gone down hill. His daughter is now 16 and has made it very clear she just wants to live with her mother. We have been in and out of courts fighting the custody battle so many times we are exhausted. This situation is affecting our relationship and our children. We recently decided to stop fighting and let her go live with her mother. My husband is still paying the court ordered child support but my question is if he voluntarily terminates his rights due to the lack of a relationship with his daughter does he still have to pay child support?

    This has been asked a thousand times in a thousand ways. Use the search feature next to the AMHD logo.

    The answer is - he has to support his child whether he sees or doesn't see her. She still needs to eat.

    You cannot voluntarily terminate your rights - you can refuse to SEE the child, of course, but you cannot have your "rights" terminated.

    And parents by law are supposed to support their children.
