    Return of Pet Deposit and Harassment
    I live in California. I have been dealing with harassment with my landlord since I moved in. When I moved in, I asked if I could get a cat for my son for Christmas. They agreed, said I had to pay the pet deposit of $300. I paid the deposit in December when I got the cat.

    About two weeks after I got the cat, the landlord started to harass me saying that I had to neuter my cat. And he needed written proof.

    I had no qualms about neutering my cat, but the Golden State Humane Society would only fix cats that are 6 month and 5 pounds.

    My cat also from the beginning had medical problems. After seeking care through several vets, we discovered while trying to get him fixed that he had an obstruction in his throat. And they refused to do the surgery, refusing to give the cat anesthesia, afraid of his breathing, since he had breathing problems (apnea due to the block)

    In May -17th, I gave notice because of the harassment. At the end of the month, I was hospitalized, and needed to rescing my notice. He told me that unless I showed him written proof that I neutered my cat, he was going to give me a three day or quit. I spoke with people in the Prop Mgmt company and they got him to back down, and agreed to have me only deal with him in writing. (they have been aware of these things, just refusing to call me back.)

    In June, we went back to the vet, and the obstruction in his throat had gotten biger and was probably a tumor, so we put the cat to sleep on June 17.

    I paid the pet deposit. My old landlord told me that legally, they had to return the $300 to me once I no longer had pets.

    What is the law and the time they have. I sent a letter to the PM company on June 18th, along with documentation.

    Also, I need an attorney because I am thinking about filing a sexual harassment claim, QUID Pro Quo, a violation of my "quiet enjoyment" due to the harassment I have received since November 2008.

    I spent $5000 to move in, with buying appliances, paint, deposits, and they keep making rules (now I have to water my grass and yards for the apartment and they know I am on disability.) But they are threatening to take my deposit for the grass and plants, when the PM company agreed to have thm water while I am diables (also provided proof)

    Please help. My 6 year old is autistic and struggles with change. Its bad enough I have to move but it will have cost me my entire saving, I don't have the money, the cost to my child's emotional well -being. I feel like I was fradulently rented a unit, and then harassed. If I don't comply, they have said repeatedly they would evict me.

    How is it sexual harassment?

    They can not just take your deposit for the yard work. They would have to give an itemized list of the deductions to corespond with what they did.

    As far as the pet deposit they should return it the same way... with itemized deductions for any damage the cat did. Cat did no damage you should get your deposit back. I really don't know how long they legally have to give it back but after you no longer have the pet I would say does sound right.

    I have not moved yet. So my question on the pet deposit depends on that fact. Do they keep my whole deposit, both the $300 pet and the $1455 rental deposit until I move, or do they surrender the pet deposit as on June 18, then I submitted that I no longer have a pet?

    On the Sexual harassment question, there are many forms of sexual harassment, some not sexual. Quid Pro Quo falls under the category because I have been told that either I water the grass, or they give me a 30 day notice to move. Or I fix the cat, or they give me a 3 day notice to quit.

    Since November, I have dealt with constant harassment from Don (and now Dean as I just got a letter stating that they didn't agree to water my grass - another lie - oh and this letter I got in my mailbox today when I returned home at 4 - was dated July 11.

    I am seriously thinking about sending them my notice dated July 5th...
