A 16 year old (1)and his friends go to a party at 1 a.m... are drinking.. have beer in their back packs.. have a witness that saw them trying to open 10 car doors.. but nothing was taken or damaged from the cars. Second boy took a large tool from an open garage and threw it on the blvd. The police were called.. arrested and charged Boy (1) for possession of break and enter tools.. allen keys, wrench and bolt cutter and possession of alcohol underage.. and have subsequently charged Boy 1 with break and enter because the wrench was identified by a homeowner. Other 4 people that were with boys gave statements saying above happened. Boy 1 said the wrench was laying on the lawn where a fence was being built. Boy 2 was charged with break and enter. The police said if Boy 1 confesses that he had wrench and was trying to get in cars, he will probably get community service and no record. Mother cannot afford a lawyer. Police want Boy 1 to come in and confess. Legal aid is not an option.. don't qualify.
What should we do?

They confess and if they show they are cooperative and remorseful the Judge may likely reduce the charges and have them pay a fine at the minimum.

It sounds like they really can't claim they didn't do it or anything that would get them out of the mess other than admitting to it.

If boy 1 did it, and boy 1 wants to confess, he should. If boy 1 didn't do it, and wants to go to trial, then he should hire a lawyer.
