3 years ago my hubby's niece was taken out of his baby sister's care and given to his older sister who has no young children.She contacted me and hubby to see if we would care for the little girl.Dss in that county agreed to let us take her.They came out and checked my house out and all that.A year ago the county that we live in asked me if we would assume custody of Amber.We said sure and have been given legal custody by this county.mom never appeared for any court proceedings in this case. We have custody of her and she is calling to say she is coming to get her. I called Dss and they said it is up to us whether she gets her back or not.They say that I need to check with the lawyer that did it.They are the ones who paid for the lawyer so shoudn't they help us make sure she is going to a safe place too?

I would think that they would do more than just say it is up to you. At the very least I would say they should be investigating if she has changed the circumstances that got her daughter taken off her.
