Hi, My marriage just ended a few months ago. My Daughter at the time was only 9 months old. My husband has not had interest in seeing her or providing for her. He does not pay child support. He has now asked me if I would allow him to waver his rights as her Dad. She is not being adopted by someone else and this will never happen, but he seems to think he can waver his rights anyway, is this true, can he waver his rights just because he wants to?

No. He can chose to not see her or be involved in her life, but it sounds as though he is doing this to get out of Child Support. Get an attorney to protect yourself from him coming back later and wanting custody AND to ensure he pays child support no matter his involvement in her life. Another Dad of the Year candidate.

In most states, no he can't, unless someone else is going to adopt.

In some states he CAN waive his parental rights---but that doesn't get him out of his parental OBLIGATIONS (Child support).

Tell him to get a lawyer and try.

In the meantime, what does the divorce decree say about child support and visitation?

YOU need to get a lawyer and get the child support order that was probably in your divorce decree enforced. If there isn't one in the divorce decree, then you need to go to court to get that established.

You can make a custody agreement where he does not see the child, has no say in the child's future, but just has to pay child support.

It sounds like you have not went to court to get any custody or child support payment ordered,
