Hello,
I'm currently unemployed, and have custody of my child. My ex-husband and I have "join managing custody" Recently, I'm being offered a job out of my current state. Although, I do not wish to have my son leaving his father, but I also have to have a job to support both of us. My ex husband does pay custody, but of course, it's not enough.

Does the law allow me to move?

If there is a custody order in place, can I take my kids out of the state?

If you want to permanently move out of state (or move within the state to a distant location that would interfere with the father's visitation schedule), then you have to either get the permission of the other parent or of a judge. If the other parent agrees, you should make sure that the permission for you to move with the children is in writing and that both parents sign it in front of a notary. If you have to apply to the court for permission, the court will look at your request to move the same way they look at modification of a custody order. As with any modification of a custody order, in order to get permission to move, you must prove to the judge that moving would be in the best interest of your child. As with all custody issues, it is probably best to talk to a lawyer about this matter.
