    Lost custody due to unemployment?
    Hello,
    I'm recently divorced for 1 year, and has custody of my child, living in Texas. I've just lost my job. Can my X take my child custody due to my unemployment? Thank you so much.

    Not likely. He might use it as grounds to raise the issue in court, but ultimately, employment is not a condition of custody, visitation or support obligations.

    Sorry to hear about your job, but custody shouldn't be an issue unless you plan on augmenting your income by selling crack to kids. And get caught.

    I'm definitely not planning to sell crack!! So I guess I'm safe for now. No fear then. Thank you so much for your sympathy. I feel like a huge weight being lifted.

    Actually it can become a factor. If your situation changes to the point that you can't support the child, he may be able to get custody, at least temporarily.

    The flip side is that it might also mean that the NCP may have to pay more in support, if her previous income were used to mitigate some of the support paid.

    I still can support my child for now. But at what point? And what does he need to prove that I can't support my little one to take over custody?

    There's no telling, but signs like moving to a smaller place in a less desirable nieghborhood. Clothes getting threadbare, etc.

    Remember a "ex" can try a lot of things, and they will use this to their benefit They may be able to hire an attorney where you can't and use that to their benefit. It all depends on how dirty and how bad the ex wants to try and take advantage
