I am in a pretty weird situation right know. OK. In January I had a BIG fight with my husband and he told me that he was going to leave me and take my 3 year old with my daughter, and then, I convinced him not to. 2 weeks ago, I got into another BIG fight with him, and he told me again that he was going to take her from me. He didn't hit me, but he grabbed my arm, and my first and it got all red,and by the way, I am 4 months pregnant; I know I should have called the police, but the thing is that I am really confused right now, and I told him a while ago that I wanted to come back to where I am from, he won't let me.. I really need help, I want to come back with her, change his name on her birth certificate, I just don't know what to do... I need help..! Thank you

You need to consult a divorce attorney NOW! But the likelihood of your being able to leave the country with your kids is small if he fights you.

Since the other parent has a right for visits, I doubt the court will allow you to take her out of the country and you can not just change a birth certificate.

You can file for divorce, or just leave him and file for custody of the child.
