Need information on QDRO from 2 years ago.
    Hi there,
I have been divorced for 2 years now. A QDRO was signed by the judge for my husband to get money from my 403B. I tried for several months to get it taken care of because my employeer had oursourced all QDROs to an outside company. After months of not getting anywhere, I gave my ex-husband permission to speak directly to the company handling the QDRO. All I know at this point is that the money has never been taken out of my 403B.
Will this QDRO ever expire if it is never put into effect?
Could I get in any trouble?
What should I do, if anything?

Just serve a copy of the QDRO on the plan, you won't be in trouble with anybody (this is more his problem than yours) and the QDRO doesn't expire.

QDRO and penalties [ 2 Answers ]

My husband wants a divorce. He will need to QDRO part of his 401K to me to buy me out of our house. I will need that money to get my own place. Who has to pay the early withdrawal penalties; him or me? He says there is no penalty involved for either side. Is this true? Barbara
