    Termination of parental rights
    My kids father has had his rights terminated by the state of Texas and child protective services and is now saying he's going to take me to court and get his rights back. After the state terminating his rights, is he able to get them back? They have been terminated due to his drug use. Hes a 3 time felon and has been to prison 3 times. He failed numerous drug test with CPS and so for that they terminated his rights.

    Are you sure his rights were actually terminated and you weren't just given full custody? What I've heard before in regards to parental rights being terminated is that it's something the parent has to petition the state for. In any case, if I were you, unless you also have had problems with cps that you're not mentioning to us, I wouldn't worry even if he does take you to court. 3 felonies and a bad report from cps isn't really the sort of thing that gets anyone custody of their kids. Even if he has parental rights, you can still fight for custody. And if he wants visitation, you can request supervised visitation.

    Not sure if this is how I reply to you or not but anyway yes I'm 100% sure his rights have been terminated. We both we involved in the CPS case over 4 years ago, it was due to us both being on meth. I got clean and fought my butt off and got my kids back and he never did anything CPS told him to do. He ended up going to prison for the 2nd and 3rd times (during the 4 years battle with CPS) I have no problem saying what I did was wrong.. just so you know. Anyway and I'm not worried he'll get custody or even visitation as it is now I DO NOT allow him around my kids because I think he may be using again. I don't know for a fact but I think so. He'll call me from time to time or pass messages threw family that he's going to get a lawyer and get his rights back so I was just curious if it was at all possible. My lifes much simpler without him in it.

    Grounds for Involuntary Termination of Parental Rights

    This site here says that a parent has the right to request their rights be reinstated. But they way they worded it all I don't know if that's only if both parents lost their rights or just in general. But maybe if you browse around the site you can find something more helpful.

    If he hasn't complied with CPS's requirements then he stands no chance of getting rights reinstated.

    No he didn't do anything CPS told him to do... thats part of why the state terminated his rights, that and he failed drug tests...
