    Suing a mortgage lawyer for breach of contract.
    I closed on my house in June of 08 and my lawyer never transferred over the underground tank insurance. I had the tank removed in October, not knowing that I did not have this policy in effect. When the tank was removed I called the insurance company, but they stated that I had no policy with them because the lawyer never transferred it over. I now have the remediation estimates and would like to bring the lawyer to court for breach of contract and damages resulting from the breach of contract because in the attorney review agreement which was signed stated that any warranties, insurances, etc. would be transferred over at closing. I have spoken with the attorney about this many times and he states that it's not his fault and that it's not their problem. I was wondering though who I would sue, the lawyer himself or the law firm. I'm doing the Special Civil suit for 15,000 dollars since no lawyer will take this case. Please help.

    Sue the lawyer, the law firm, and the parking lot attendant. What? He parks their cars, doesn't he? Ok, forget about the parking dude.

    PS> What was your insurance claim anyway? Was somebody hurt when it was removed?? Did you want the insurance company to PAY for the removal? Do you have a policy - if even from the previous owner??

    It was an actual insurance policy on the tank for leaking. It had 17 holes in it and that's what they were SUPPOSED to cover. The previous owner had a policy, but since it wasn't transferred to me (and at that point over anyways) they refused to cover any damages. Totaling about 18 grand in damages. :(
