Suing a mortgage lawyer for breach of contract.
I closed on my house in June of 08 and my lawyer never transferred over the underground tank insurance. I had the tank removed in October, not knowing that I did not have this policy in effect. When the tank was removed I called the insurance company, but they stated that I had no policy with them because the lawyer never transferred it over. I now have the remediation estimates and would like to bring the lawyer to court for breach of contract and damages resulting from the breach of contract because in the attorney review agreement which was signed stated that any warranties, insurances, etc. would be transferred over at closing. I have spoken with the attorney about this many times and he states that it's not his fault and that it's not their problem. I was wondering though who I would sue, the lawyer himself or the law firm. I'm doing the Special Civil suit for 15,000 dollars since no lawyer will take this case. Please help.
