    I am asking a about claiming a child
    I had my boyfriend claim my son and now some one else in my family wants to claim him or tried to claim him and now they are wanting to file charges due to my son beining in there home also and I need to know what will happen cause our taxes are already back and gone can you give me osme information on this I would really appreciate it and will be waiting for your answer I just need to know will I or my boyfriend have to pay this back or go to jail because of it thank you very much tammy

    Did you boyfriend provide more than 50% of the child's support? If so, then he had a right to claim him. So you need to figure out how much the child lived with you and how much your boyfriend contributed to his support.

    Its unlikley you will go to jail, but if its determined he wasn't entitled to claim the child, then an amended return will need to be filed and any difference paid back.

    Is there a custody order on the child?

    You knew there was a conflict and you apparently already believe they had more right to file because you are talking about the fact that the money is already gone?
