    My Husband is in Jail
    So my husband has been in jail for the past almost 5 months. We just had a little baby girl about three and a half months ago. He did not get to be there. He was charged with possession of marijuana. He got ten years do three and the rest probation. But he's still in county jail and we're waiting for him to get transferred to state prison so he can get to hold our daughter, since visitation is in person and a longer time. They won't tell us how much longer they are going to take before they transport him, though. And I've also heard that he won't have to do the whole three years if he has good behavior, and since they are really booked up right now he'll get released not too long after he's in diagnostics. I hope some one can tell me how long he really is going to be there.

    You aren't going to like the answer but he will be there as long as the system wants him there. Early release has everything to do with jail crowding and there is no real way to give a solid answer that isn't a blind guess.

    Assume he will be there for 3 years and everything else is a gift.

    I'm sorry your husband is a victim of the state. THEY'RE the ones who should be in jail.

    The 3 years is the good behavior normally instead of the 10 years.

    Some states release early when iit is full but do't expect it

    TEN years for possession of marijuana?? Doing three years? Wow that constitutes as cruel and unusual punishment.

    10 years for possession of how much? Also if he did not have any priors he could be out in the 3 years provided they need the room for someone else.
