    Child Support Modification
    Our daughter's ex-husband has filed for a child support modification. He apparently is not working at this time. He must have been collecting unemployment because she has received a fraction of the original court ordered judgement each month. Our daughter and Grand Daughter live with us and have since her birth 6 years ago. Her ex is doing "cash" jobs so proving he makes an income will be impossible for us. Our daughter has sole legal and physical custody of our Grand daughter. He has no visitation. My questions are... if he is not working does that mean he pays nothing? Since our daughter lives with us does she have to claim our income under the "who lives with me" section? And my last question is does our daughter have to appear in court? (She has not had to see him since the divorce was final 5 years go) She also still owes her over $7,000.00 (for attorney fees) that was awarded to her that she has not received one dime of. Do they take that into consideration as well?

    If your daughter does not force the issue, then he has to pay her nothing, in most instances; although some states are very proactive in collecting child support. She will have to file a motion to hold him in contempt of court as to unpaid attorney fees. As for working for cash, she may need to retain a private eye to see where he goes each day.
