Do I still need spousal concent to make 401K distribution?
I have a 401K plan with my former employer. I remember that I put my mother there as the only beneficiary. I was married when I started this 401K. Because she abandoned the marriage, court issued a divorce order two years ago without saying anything about property division. Now my question is: can I cash out my 401K without her consent?

    Thanks a lot.

I would like to take money out of my 401k where I no longer work because I need to pay off some debt since I stopped working to have a baby. A home equity loan is not an option for me right now, though that would be the best thing, we already have that. I spoke to a rep, who said I can take the...

401k distribution $58,000 [ 1 Answers ]

I withdraw $58,000 out of my 401k for a first time home buyer. Only to find out that that rule applies to IRA's. Michigan taxes me at around 4% on my income and the $58,000. It appears that I can write off the $58,000 on schedule 1 against my income for Michigan tax purposes. Is that the case??...
