    Father wanting to voluntarily sign over his rights.
    Background:

    My daughter is two and a half years old. Her father and I were together for 3 years, until she was 8 weeks old. We went separate ways, and are now both married (just not to each other, ha!). He and his new wife have one child together, and we are both pregnant with our second children.

    He's basically been estranged the past year. Not much contact, very little visits. I had turned him over to child support recovery a little over a year ago, when him and the bride were expecting their first child. (Sounds crappy, but oh well!) I just got an email from the Wife, saying how he "deep down" wants to be there for her, but that he can't afford to right now -- and he think it'd be better for everyone for him to sign over his rights. I agree. She doesn't know him as anything, but especially "Daddy", as that what she started voluntarily calling my Husband when she was 6 months old.

    We were never married, and he was never legitimized. He signed the BC, and she of course carries his last name. Without Lawyers and big court costs, what kind of process can we go through for him to sign over his rights and it all be DONE!?

    How long have you been married ? In most cases unless your husband is willing to adopt it would be very difficult to have the fathers rights signed away. Has your husband spoken of adoption ?

    No, he is not going to get to just "sign his rights away" There would not be men sitting in prison today for not paying child support if they could just sign rights away.

    If he signed the birth certificate he has "legitimized" there is nothing else he has to do except sign the birth certificate, Had he not signed , then he may have to have a DNA test.

    You will need an attorney, and your new husband will have to adopt
