    Gaining custody of child in my care
    Hi. My brother fathered a little girl in 2005. Him and this young lady was dating he went to jail. At the time of him being in jail the mother decide that she wanted to be free so she walked off and never returned for the child. Until one day the dept of children and family came to my door looking for the child. Cuase her mother current boyfriend got out of prison they saw she had child. They inspected my home and her school she was attending at the time. The agency made her sign over temp guardianship to me. I never ask this young lady for anything while I been caring for the child. Now she asking for her back saying she got her life back together and things without proving she do. So how do I file for full custody of the child sincce we do not live in the same state when she first left at.

    First its not a good idea to piggyback your question on someone else's. This can lead to confusion. You should start a new thread. So I've moved your question to its own thread.

    Second, you better get an attorney. Since you apparently did not legally get control of the child, there is a reasonable possibility that she can regain custody if she has gotten her act together.

    The attorney will tell you how to handle the petititon to gain custody. Most likely you will have to adopt the chld.

    Yes, courts do often give the mother the child back, esp if they have gotten their life back on track

    Before would have been the best time to go to court, but you need an attorney ASAP
