    security deposit
    Hello, I live in Las Vegas, NV, I rent a house, been renting almost 4 years, singned a I yr lease agreement and have been paying rent sin then withiut a lease renewal. I gave my landlord 3 weeks notice that I will be moving on the 15th of the mont, he states that I can only moe on the 1st because of my lease. I told him he never renewed the leas and said the initail lease was ongoing. If I move on the 15th, he will keep my $1000 deposit. I requeasted he take the $600 out of the deposit and return to me $400. He said I needed to move in the 1st to get my deposit. Is this legal?

    If your signed lease expired, then you merely became a month-to-month tenant. I'm not sure of NV but I know quite a few states have a 30-day notice requirement; you need to give your landlord 30 days notice, not 3 weeks.

    From what I understand, if rent is due on the first and you are occupying the apartment past that date, then rent is due for that month. So unfortunately, I believe your landlord is in the right. If you don't pay for the full month of rent, he can keep your deposit(assuming rent is $1000 a month).
