    Child support arrearage
    Hello,

I would like to know how the court system will treat my case. I owe approximately

50,000 dollars in back child support due to the fact I have been disabled for 3 1/2 years.

My ex-wife receives 1000 dollars a month for my 2 children, which comes out of my

Social security. My credit is very bad & my house has been in foreclosure once, & fixing

To be a second time. My new wife is seeking disability and she just started receiving her

Met LIfe long term disability. I go to court December 11, 2009 and my ex-wife wants her

    Arrearages paid up.

What will be the outcome in the state of Florida? I also want to know if I am not seeing

My children like the child guidelines state. I may see them maybe 4 hours a week with

    No over night visitation.

I will patiently wait your answer.

    Thanks & God bless.

There is no predicting what a judge will do. However, if you can prove that your arrears were the result of a significant decrease in income, you may be able to get the court to agree to waive some and workout a schedule for the rest.

You should have applied for a modification of your support as soon as you became disabled.

As for visitation, that's a separate issue. If the mother is interfering with your couirt ordered visitation, you can ask the court to order her to comply.

You should have petitioned for a modification three years ago when you became disabled. You can still do it now but I won't promice that it will help with the arrears that have already stacked up it should however prevent more from being added though.
