    Child support payment
    I have been paying child support for 3 children for 17 years two boys 17 and one girl 13 I have fallen behind by one month on my child support due to lack of funds now I lost my job 3 years ago and still paid my child support for those three years doing odd jobs. Now I do not owe the state any back child support at all beside the one month, now I have to go to court for contempt because the mother wants her one month worth of money and says she wants more money from me than I am already paying .I only have one year to go to pay till my kid is out of high school can she ask for more money since I do not have a job? And the original order has always been paid for 17 years and I only missed one month.. and what about my kid? He is always getting arrested lost his license for drinking and driving and has two jobs and most of the time he does not live there with his mother... :confused:

    You go to court and you explain to the judge that you are unemployed and can no longer make the same payments. You will need to show proof of this. Ask for a modification of the support order until you can get back on your feet.

    I will do that but how can I prove I am not working ? I meen I have no problem paying the existing order its just I want it to stay the same.I have only fallen a month behind but since then have continued my payments.

    Were you receiving unemployment benefits? That would be proof. A termination letter from your previous company would also help.

    I did not go to unemployment and I might be able to get a letter from my old job. Thanks I did not think of that

    How long have you been out of work? Do you have tax returns that might show reduced or no income?

    If you have not been with that job for three years now you should have tax returns, as scott mentioned, that would be a great asset to you right now. If you do have proof of your odd jobs then you could bring in records from them too but really your tax returns would be a greater resource.

    I have not filed tax returns since I lost my job three years ago. And I have no proof of odd jobs since it was all under the table

    Then you really need to have that letter from your last employer showing that you haven't had that job for the past three years.

    You might have trouble proving you aren't working, but they will need to prove that you are.
