    3 day eviction for 35.50 + late fees
    Can the rental agency give me a 3 day notice of pay rent or turn over possession if I am only a month late of 35.50 plus a 100.00 fee they added. If when they rented me the apartment they knew I was currently unemployed and I told them that I only had an income of $200.00 a week and I was signed up to be a substitute. I also have small children all under the age of 6 years old. Was I taken for a ride by the agency, being that I was asked to move out of my previous rental due to foreclosure that I told them about. And so my rental period was cut short. I was suppose to stay until the end of September, but I was told to be out by the end of August instead.

    Hello A:

    Yes, they can give you one... But, they're a looooong ways from evicting you. The only factor that matters is the lease you signed and the date your rent is due. All the other stuff, while sad, isn't grounds for not paying your rent on time.

    However, as long as you cure the defect before he files an eviction lawsuit, he is more than likely, required to take it. That means you probably have two weeks or so. It depends, really, on your state landlord/tenant laws, and how efficient your landlord is. We have a copy of your state laws right here for your perusal, at the top of the real estate page on a "sticky note".
